Couple Files Wrongful Death Suit due to Loss of Unborn Child

An unusual case is going before the Supreme Court in the state of Utah this month. News sources say that how the judges rule on this case could affect wrongful death lawsuits across the nation.

Two parents in Utah have filed a wrongful death lawsuit against a prenatal clinic. The couple went to the clinic for prenatal care, but their child died in stillbirth. They claim that the negligence of the medical staff at the clinic is to blame for the death of their child. The woman felt that something was wrong with her fetus at nine months, but when the couple went in for a routine checkup, the doctor said there was nothing to be concerned about.

While they have not been successful in suing the clinic and the doctor at the lower court levels, they are hoping to be successful as they take their case to the Supreme Court. The justices are now deciding whether you can file a wrongful death lawsuit for an unborn child or not.

Did you lose someone due to another person's negligence in Nevada? If so, you may be able to move forward with a wrongful death lawsuit to seek damages.
