Passenger Killed in DUI Accident
A 28 year old woman lost her life on Monday after she was involved in an auto accident. Shanna LaPelusa was riding with her friend, 26 year old Summer Mackie, when the crash occurred. Mackie and another passenger were taken to St. Rose Siena for their injuries. La Pelusa, who was ejected from the car when it hit the wall, was pronounced dead on arrival.
Chemical test results are still pending, but Mackie has already been charged with driving under the influence and vehicular manslaughter. If she is convicted, she may face years in prison and heavy fines. She will also have her license suspended for a period of time.
If she is found guilty, La Pelusa's family will have an easier time with a personal injury claim against her, as the verdict can be taken as sufficient proof of her gross negligence. They may seek to recover funeral expenses, lost wages and benefits and for their pain and suffering.
