A Las Vegas local was the victim of a crash in May in which her 2002 RAV4 Toyota not only failed to break, but increased in acceleration without application to the gas pedal. The auto accident injured the driver, Carolina Salvador, and killed her mother, Jovita Salvador. Her lawsuit against Toyota has recently been transferred to U.S. District Court.
The 2002 RAV4 is not the first Toyota vehicle to have probelms with unintended and deadly acceleration. Other Toyotas have been recalled for sticking accelerator pedals and floor mats that impede proper pedal use. Salvador's lawsuit claims that the 2002 RAV4 should have been included in these recalls.
According to the lawsuit, there have been thousands of consumer complaints about this issue, and of the cars that are affected by it, only 30% were recalled. In addition, the National Highway Traffic Safety Adminitration stated that for Toyotas made in the past decade, 89 deaths and 57 injuries may have been caused by sticking pedals.
